These General Conditions of Sale govern the methods and conditions of sale of the products marketed on the sitewww.tavoloconsolle.com
All sales contracts by Ram Industry srl to third parties called "Customers" are governed by these General Conditions, which form an integral and substantial part of every proposal, order and purchase order confirmation of the products themselves.
The "Customer" declares to accept and respect these General Conditions.
The conditions of sale applicable to your order are those in force on the date of the order.
1. PRODUCTS: PRICES AND FEATURES
Unless otherwise indicated, the prices of the products published on the site www.tavoloconsolle.com must be considered VAT INCLUDED. The prices of the products published from time to time by Ram Industrie srl cancel and replace the previous ones.
Ram Industrie srl reserves the right to change the prices of the products published on its website at any time. Product prices are valid at the time of the order. Unless otherwise indicated, the images of the products are indicative and not binding. The Customer is responsible for the choice of products.
2. ORDERS - BILLING
The fiscal documentation (invoice) relating to the ordered products will be issued by Ram Industrie srl and will be sent by email to the customer.
Invoices can only be requested for the relevant month (in which the purchase is made), the request for an invoice for a purchase made the previous month CANNOT be processed. If you want an invoice, you must enter your tax information when creating your account; if this is not the case, a non-fiscal document (which acts as a receipt) will be generated but not the invoice.
It is not possible to issue invoices before product delivery.
3. DELIVERY OF PRODUCTS AND PASSING OF RISK, ART. 63 Legislative Decree 206/2005
The delivery time once your order is shipped is 5-6 business days, depending on your location. However, these times cannot be 100% guaranteed by Ram Industrie srl, as they may vary depending on stock availability, logistical difficulties of the couriers used (e.g. strikes or vehicle problems), the presence of holidays and / or in based on the place of delivery (e.g. in remote-difficult areas or islands). The delivery times indicated are therefore an ESTIMATE.
The goods in STOCK at the courier's depot due to repeated impossibility of delivery remain available to the customer for a maximum of 5 working days; after this deadline, the order will be canceled; in this case the ordered items will return to the sender, and the order will be refunded to the customer but only partially (net of the shipping and storage costs accrued, which are charged to the customer). Delivery takes place ONLY at street level , unless the delivery service to the floor is paid during the order phase, and takes place only from Monday to Friday from h. 8 to about 18. We remind you that any return takes place ONLY on the street level instead.
- PASSING OF RISK, ART. 63 Legislative Decree 206/2005
1. In contracts which impose on the professional the obligation to arrange for the shipment of the goods, the risk of loss or damage to the goods, for reasons not attributable to the seller, is transferred to the consumer only when the latter, or a third party designated by him and other than the carrier, takes physical possession of the goods.
2. However, the risk is transferred to the consumer already at the moment of delivery of the goods to the carrier if the latter has been chosen by the consumer and this choice has not been proposed by the professional, without prejudice to the consumer's rights vis-à-vis the carrier.
4. RIGHT OF WITHDRAWAL
Pursuant to the Legislative Decree 206/2005 the "consumer" Customer has the right to withdraw from the contract and to return the ordered products, without any penalty and without specifying the reason, within the deadline of 14 days from receipt of the products themselves (after the 14-day deadline, Ram Industrie S.r.l. will not guarantee the return). The right of withdrawal referred to in the previous article must be exercised by the Customer, under penalty of forfeiture, by sending an email to: email@example.com
All returns (which must be perfectly intact and accompaniedONLY from the original packaging) must be authorized in advance by the Customer Service via email. The return of any item is accepted without hesitation, as long as it is in PERFECT CONDITION and SEALED, FREE OF ANY KIND OF WEAR, NEITHER DAMAGED, NOR SCRATCHED, exclusively with the original packaging (including internal protections). The right of withdrawal referred to in the previous article CANNOT be exercised by the Customer if the products have been used by the Customer.
The customer can:
- return the product to the following address: Via G. Verga 6/8 - 20045 Lainate (MI), at your expense. The return shipment is charged to the customer, including liability in case of loss or damage to the products.
- have Ram Industrie collect the products with his courier, the goods must be brought to the street level. The cost of organizing the return is charged to the customer (it varies according to the weight / volume of the product). customer).
Once the products have been received (and their integrity checked); the maximum term within which the refund will be made from the return of the goods is 10 days. within 10 (ten) days from the date on which you become aware of the exercise of your right of withdrawal, once you have verified that the withdrawal has taken place in compliance with the above conditions.
5. CONFORMITY AND GUARANTEE ON THE GOODS
It is the Customer's responsibility, at the time of delivery of the goods, to check that the packaging is intact, not damaged, nor wet or otherwise altered, even in the closing materials. Any damage must be immediately reported to the courier making the delivery (possibly accepting the goods with a SPECIFIC RESERVE to be written in the courier's "handheld-holder", indicating the problem encountered).
In the event that the product has been damaged during transport, the Customer must notify Ram Industrie srl by e-mail (firstname.lastname@example.org) within 3 days of delivery, detailing the damage that the product has suffered (together with photos - proof of damage suffered) this in order to take advantage of the insurance included in the price.
In any case, at the time of delivery the products must be checked by the customer in order to ascertain that they correspond to the items ordered and that they do not present manufacturing defects or further conformity defects. In addition to the specific guarantees that are eventually provided to the customer together with the delivered product, the legal guarantees provided by Italian law are also applicable to the sale of the products purchased on the site.
Pursuant to art. 130 of the Consumer Code, the seller is liable to the consumer for any lack of conformity existing at the time of delivery of the goods.
In the event of a lack of conformity, the consumer has the right to restore, without charge, the conformity of the goods by repair or replacement, or to an adequate reduction in the price or to terminate the contract.
The legal guarantee of conformity of the goods, provided for by art. 128 ff. of the Consumer Code, is equal to 2 years: specifically, the seller is responsible, pursuant to article 130, when the lack of conformity occurs within two years from the delivery of the goods. In particular, the rights arising from this guarantee may be exercised on condition that the products have been used correctly, with due diligence and in compliance with the intended use and as provided in the enclosed indications, as well as upon presentation by the customer of the transport document. It is understood that the consumer loses this right if he does not report the lack of conformity to the seller within 2 (two) months from the date on which he discovered the defect (Article 132 of the Consumer Code).
The territorial jurisdiction is exclusively that of the Court of Milan.
Consumers residing in Europe are also informed that the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by the European consumer to resolve in a non-judicial way any dispute relating to contracts for the sale of goods and services stipulated online and / or deriving from them.
